Award variation – expense related allowances – consent order issued

REASONS FOR DECISION

On 29 May 2008, an application was lodged by the Community and Public Sector Union (State Public Services Federation Tasmania) Inc., pursuant to s.23 of the Industrial Relations Act 1984, to vary the General Conditions of Employment Award with respect to expense related allowances.

A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Thursday 5 June 2008. At the hearing Ms J Fitton appeared for the Minister administering the State Service Act 2000. Ms C Serra appeared for the Community and Public Sector Union (State Public Services Federation Tasmania) Inc.  Mr D Wishart appeared for the Australian Education Union, Tasmanian Branch and Mr P Aiken for the Health Services Union of Australia, Tasmania No. 1 Branch. All of the above gave oral submissions in support of the application.

I am satisfied that the variation is consistent with the Wage Fixing Principles and the public interest requirements of the Act. The variation is made with the consent of the Tasmanian Trades and Labor Council.

The order reflecting this decision, with an operative date from the first full pay period to commence 5 June 2008, is attached.
