REASONS FOR DECISION

 

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Health Services Union of Australia, Tasmania No. 1 Branch (the union) and Able Australia (the employer), was for the purpose of filing an industrial agreement with the Commission.

 

[2] A hearing commenced at the Commonwealth Law Courts, Hobart, on 11 September 2008.

 

[3] The agreement, to be known as the ABLE AUSTRALIA (SALARY PACKAGING) INDUSTRIAL AGREEMENT 2008, is to be operative on and from 12 September 2008 and it is to remain in force for a period of twelve months.

 

[4] The agreement applies to all employees (whether members of a registered organisation or not) who are employed by Able Australia under the terms of the relevant Collective Agreement or Award.

 

[5] Oral submissions were presented by Ms R Knox for the union and by Mr I Evans for the employer.

 

[6] Having considered the consent submission of the parties, I am satisfied that the agreement is consistent with the Wage Fixing Principles and the public interest and no disadvantage tests required by the Act and I decide accordingly.

 

[7] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
