Industrial agreement – salary packaging and salary sacrifice - agreement approved – operative 25/9/08 – to remain in force until 30/6/11 – forwarded to the registrar for registration

 REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 (the Act) by the Health Services Union of Australia, Tasmania No. 1 Branch (HSU1) and the Australian Municipal, Administrative, Clerical and Services Union (AMACSU) (the unions) and Anglicare Tasmania Inc. (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] A hearing commenced at the Edward Braddon Commonwealth Law Courts Building, Hobart, on Wednesday 24 September 2008.

[3] The agreement, to be known as the Anglicare Tasmania Inc. (Salary Packaging and Salary Sacrificing) Agreement 2008, is to be operative on and from 25 September 2008 and it is to remain in force until 30 June 2011.

[4] The agreement applies to all employees who are employed by Anglicare Tasmania Inc. in the State of Tasmania; and who are members or are eligible to be members of the HSU1; or who are members or eligible to be members of the AMACSU.

[5] Ms R Knox appeared for the HSU1 with Mr T Jacobson, and Mr C Dodds appeared for the ASU.  Mr J O’Neill appeared for the employer.

[6] Having considered the consent submission of the parties, I am satisfied that the agreement is consistent with the Wage Fixing Principles and the public interest and no disadvantage tests required by the Act and I decide accordingly.

[7] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
