REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Australian Education Union, Tasmanian Branch and the Minister Administering the State Service Act 2000, was for the purpose of filing an industrial agreement with the Commission.

[2] On 13 October 2008, the Commission convened a hearing at Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania to commence on Tuesday, 21 October 2008 at 9.00 am.

[3] The agreement, to be known as the TAFE Tasmania Teachers’ Agreement 2008, is to be operative on and from 21 October 2008, with the exception of Clause 7 – Classifications and Salaries to be operative from the first full pay period on or after 1 March 2008 and it is to remain in force for a period of 3 years.

[4] Mr C Lane with Mr R Dale for the Australian Education Union, Tasmanian Branch and Mr T Kleyn with Ms A Milliss for the Minister Administering the State Service Act 2000, presented submissions in support of the consent application.

[5] Having considered the consent submissions of the parties, I am satisfied the agreement is consistent with: the Wage Fixing Principles; and the public interest and no disadvantage tests required by the Act, and I decide accordingly.
