TASMANIAN INDUSTRIAL COMMISSION Industrial Relations Act 1984 Minister Administering the State Service Act 2000 and United Firefighters Union of Tasmania
Industrial dispute – industrial action concerning Tasmanian Fire Service - recommendation RECOMMENDATION [1] On 7 November 2008 the Commission conducted a hearing (conciliation conference) in relation to an s.29 dispute notification from the Minister Administering the State Service Act 2000 (the Minister). [2] The subject matter of the notification stated, in part: “Employees, members of the United Firefighters Union of Australia (Tasmanian Branch), employed within the career fire brigades in Hobart, Launceston, Burnie and Devonport in Tasmania Fire Service are refusing to undertake duties in the career fire brigade environment other than: · Operational preparedness and emergency response; · On shift fire investigations; and · The completion of sick leave forms and overtime forms; As a result, the employees are refusing to undertake other duties that are consistent with their Statement of Duties and their obligations as an employee.” [3] Mr R Warwick appeared for the United Firefighters Union of Tasmania (the UFU); Ms R Pearce appeared for the Minister, with Mr M Brown, Mr L Smith and Mr A Newell. [4] At the conclusion of the conference on the above date the Commission stated that it would issue a recommendation to try to progress the matter to a resolution: It is my strong recommendation that the Minister and the United Firefighters Union of Tasmania enter into immediate negotiations on all outstanding issues relating to the matters in dispute. I also recommend in the strongest possible terms that the status quo, which existed prior to this dispute, be reverted to by the lifting of all bans and limitations as soon as possible concerning the undertaking of duties as detailed above. [5] The file will remain open and the matter will be re-listed on application.
