REASONS FOR DECISION

 

[1] On 6 November 2008, an application was lodged by The Australian Workers’ Union, Tasmania Branch (AWU), pursuant to Section 23 of the Industrial Relations Act 1984, to vary the AWU (Tasmanian State Sector) Award.

[2] When this matter came on for hearing on 21 November 2008 Mr R Flanagan appeared for the AWU and Mr P Baker for the Minister administering the State Service Act 2000.

[3] Mr Baker explained that there were three components to this application.

[4] Firstly, the application introduces a formula for the calculation of fortnightly pay which is consistent with awards in the public sector generally.

[5] Secondly, arising out of the Public Sector Union Wages Agreement 2008, Clause 2 Rates of Pay, is varied by including a new subclause which provides for a 4% salary increase operative from the beginning of the first pay period to commence on or after 27 November 2008.

[6] Thirdly, a savings provision is included in the personal leave clause.

[7] Mr Flanagan supported the submissions of Mr Baker.

[8] I am satisfied that the application is consistent with both the Wage Fixing Principles and the public interest requirements of the Act. The application is granted operative from the beginning of the first pay period to commence on or after 27 November 2008.
