Variation of registered industrial agreement T13128 of 2008 – application to vary approved - operative on and from 1 October 2008 – to remain in force until 28 February 2011

REASONS FOR DECISION

[1] On 1 December 2008, the Australian Education Union, Tasmanian Branch (the AEU) and the Minister administering the State Service Act 2000 (the Minister), lodged with the Registrar, pursuant to Section 59 of the Industrial Relations Act 1984, an application to vary the Teaching Service (Tasmanian Public Sector) Salaries and Conditions of Employment Agreement 2008.[1]

[2] When this matter came on for hearing on 2 December 2008, Mr C Lane appeared for the AEU and Mr M Watson appeared for the Minister.

[3] The parties advised that the application sought to replace Clause 18 – Attendance days and insert Schedule 2 into the agreement, with an operative date on and from 1 October 2008 and to remain in force until 28 February 2011 .

[4] I am satisfied that the variation to the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[5] Pursuant to s.59(2) of the Act, the variation to the agreement is approved operative on and from 1 October 2008.

[6] An Order giving effect to the variation is attached.
