DIRECTIONS


On 7 November 2008, the Australian Nursing Federation Tasmanian Branch, (the Union), applied to the President, pursuant to s.29(1) of the Industrial Relations Act 1984 (the Act) for a hearing before a Commissioner in respect of an industrial dispute with the Minister administering the State Service Act 2000 (the employer) arising out of the alleged breach of the Nurses (Tasmanian Public Sector) Enterprise Agreement 2007.

As agreed between the parties on 18 March 2009 before the Tasmanian Industrial Commission , the following Directions are issued.

These Directions refer to the agreed issues arising from the TIC proceedings on 6 February 2009.  This document should be read in conjunction with the NPICU Dispute Form summary sheet.  Matters under dispute are identified by ‘Issue’ Numbers.

Pursuant to s21(2)(n) I hereby Direct that:

(1) The Minister administering the State Service Act 2000 by himself, his servants, employees and agents including the Royal Hobart Hospital and its Executive Director of Nursing take every such reasonable action to alleviate sustained unreasonable workloads in the Neonatal and Paediatric Intensive Care Unit (NPICU) and to ensure reasonable workload principles can be applied in the future.  Movement toward resolution of this ongoing dispute requires the following:

(a) Issue 1 provide the Australian Nursing Federation (ANF) Tasmanian Branch with ongoing KPI information by the 14th day of each month for the life of this dispute. 

(b) Issue 18 provide ANF with recruitment information (number of vacancies, classification, commencement date and employed FTE) by the 14th day of each month for the life of the dispute.

(c) Issue 2 RHH Nursing Management to commence discussions with nurses in NPICU to determine mutually agreed acceptable levels of overtime, double shifts etc and provide this data to ANF by 30 April 2009.

(d) Issue 11 that DHHS finalise the details of the Interstate Transfer panel and provide ANF with the details of dates etc by 30 April 2009.  RHH to develop selection criteria for interstate transfers and provide this information to ANF within 60 days before the panel convenes.

(e) Issue 12 DHHS provide ANF with the required information to enable benchmarking of NPICU as per Schedule 2 of the Nurses (Tasmanian Public Sector) Enterprise Agreement 2007.  This information includes classification of each funded bed (eg HDU/ICU), occupancy of each type of bed over the preceding 12 months by the 14th of every month.

(f) For the future of this dispute, DHHS must provide ANF with any requested and agreed information within the mutually agreed timeframes.

(2) These Directions shall commence on 18 March 2009.
