Industrial Agreement - agreement approved – operative 1 January 2009 – to remain in force until 19 March 2011 - forwarded to the Registrar for registration

 

REASONS FOR DECISION

 

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Australian Education Union, Tasmanian Branch (the AEU), The Community and Public Sector Union (State Public Services Federation Tasmania) Inc. (The CPSU) and the Minister Administering the State Service Act 2000 (the Minister), was for the purpose of filing an industrial agreement with the Commission.

[2] On 23 December 2008, the Commission convened a hearing at Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania, to commence on Wednesday, 24 December 2008 at 9.30 am.

[3] The agreement, to be known as the Post Year 10 Teacher Aides, Participation Assistants and VET Student Assistants Agreement 2009, is to be operative on and from 1 January 2009 and remain in force until 19 March 2011.

[4] The agreement shall apply in respect of the employment by the employer of Teacher Aides, Participation Assistants and VET Students as defined in Clause 10 – Classification Structure.

[5] Mr C Lane, for the AEU; Mr M Johnston, for the CPSU; and Mr M Watson, for the Minister; presented submissions in support of their consent application.

[6] Having considered the consent submissions of the parties, I am satisfied the agreement is consistent with: the Wage Fixing Principles; and the public interest and no disadvantage tests required by the Act, and I decide accordingly.

[7] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
