REASONS FOR DECISION

 

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Australian Education Union, Tasmanian Branch (the union) and the Minister Administering the State Service Act 2000 (the Minister), was for the purpose of filing an industrial agreement with the Commission.

[2] On 23 December 2008, the Commission convened a hearing at Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania, to commence on Wednesday, 24 December 2008 at 9.30 am.

[3] The agreement, to be known as the Post Year 10 Teaching Staff Industrial Agreement 2009, is to be operative on and from 1 January 2009 and remain in force until 20 October 2011.

[4] The agreement applies to all persons employed under the State Service Act 2000 in classifications contained in the Post Year 10 Teaching Staff Award and employed in the Tasmanian Academy, Tasmanian Polytechnic or Tasmanian Skills Institute.

[5] Mr C Lane, for the union; Mr M Watson, for the Minister, presented submissions in support of their consent application.

[6] Having considered the consent submissions of the parties, I am satisfied the agreement is consistent with: the Wage Fixing Principles; and the public interest and no disadvantage tests required by the Act, and I decide accordingly.

[7] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
