New award - application approved – operative date 1 January 2009

REASONS FOR DECISION

[1] This is an application pursuant to s 23 of the Industrial Relations Act 1984 (the Act) by the Australian Education Union, Tasmanian Branch to make an award to be known as the Post Year 10 Teaching Staff Award (the award).

[2] The following employee organisation has an interest in the award pursuant to s.63(10) of the Act:

Australian Education Union, Tasmanian Branch

[3] The following employer has an interest in the award pursuant to s.62(4) of the Act:

The Minister administering the State Service Act 2000.

[4] The award has been negotiated by the parties and is presented to the Commission by consent. The parties informed the Commission that the award has been established to cover all persons employed under the State Service Act 2000 at the Tasmanian Academy, Tasmanian Polytechnic or Tasmanian Skills Institute in the relevant classifications named in the award.

[5] I have perused the provisions found in the award and am satisfied that it is in accord with the Wage Fixing Principles and the public interest requirements of the Act.

[6] The application is granted. The Order giving effect to this decision, with an operative date of 1 January 2009, is attached.
