Rescission of award – award rescinded - operative 1 January 2009

 

REASONS FOR DECISION

 

[1]         This application, made by Australian Education Union, Tasmanian Branch (the union), sought to rescind the Tasmanian TAFE Teachers’ Award.

[2]         The matter was set down for hearing on Wednesday, 24 December 2008 at 9.30 am in the Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania.

[3]         The following organisations were advised of the hearing details:

  •  Australian Education Union, Tasmanian Branch
  • Tasmanian Trades and Labor Council
  • The Minister Administering the State Service Act 2000
  • Minister for Workplace Relations

[4]         Mr C Lane, for the union, presented a submission to the Commission which, simply stated, confirmed that the award had been superseded by the new Post Year 10 Teaching Staff Award, therefore the award no longer serves a purpose and should be rescinded.

[5]         Given the submissions of the parties to the award, I hereby determine that the Tasmanian TAFE Teachers’ Award be rescinded as an award of the Tasmanian Industrial Commission on and from the 1 January 2009, and I so Order.

[6]         The Order giving effect to this decision is attached.
