REASONS FOR DECISION

 

[1] On 22 January 2009, an application was lodged by The Australian Workers' Union, Tasmania Branch, pursuant to Section 23 of the Industrial Relations Act 1984, to vary the AWU (Tasmanian State Sector) Award.

[2] When this matter came on for hearing on 29 January 2009, Mr R Flanagan appeared for The Australian Workers' Union, Tasmania Branch. Mr K Grey appeared for the Minister administering the State Service Act 2000.

[3] Mr Flanagan submitted that this application sought to Tasmanian State Service Award and to reflect changes which have occurred since August 2006.

[4] Mr Grey consented to the application and foreshadowed further changes to the Award so as to reflect harmonisation across the state sector.

[5] I am satisfied that the application is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[6] The application is granted operative from the beginning of the first pay period to commence on or after 27 November 2008.

[7] The Order reflecting this decision is attached.
