Rescission of award – award rescinded - operative 29 January 2009

 

REASONS FOR DECISION

 

[1] This application, made by the Minister Administering the State Service Act 2000 (the Minister), sought to rescind the Metal Trades (State Employees) Award.

[2] The matter was set down for hearing on Thursday, 29 January 2009 at 9.30 am in the Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania.

[3] The following organisations were advised of the hearing details:

  • Automotive, Food, Metals, Engineering, Printing & Kindred Industries Union
  • Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia
  • Tasmanian Trades and Labor Council
  • The Minister Administering the State Service Act 2000
  • Minister for Workplace Relations

[4] Mr K Grey, for the Minister, presented a submission to the Commission which, simply stated, confirmed that the award had been superseded by the new Tasmanian State Service Award[1], therefore the award no longer serves a purpose and should be rescinded.

[5] I hereby determine that the Metal Trades (State Employees) Award be rescinded as an award of the Tasmanian Industrial Commission on and from the 29 January 2009, and I so Order.

[6] The Order giving effect to this decision is attached.
