REASONS FOR DECISION
[1] On 12 February 2009, an application was lodged by the Liquor, Hospitality and Miscellaneous Union - Tasmanian Branch (the union), pursuant to s.23 of the Industrial Relations Act 1984, to vary the Miscellaneous Workers (Public Sector) Award re Launceston Cup Day. [2] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Monday 16 February 2009. At the hearing Mr M Watson appeared for the Minister administering the State Service Act 2000. Mr P Tullgren appeared for the union. Both of the above gave oral submissions in support of the application and agreed to amend the application to read Cup Day instead of Launceston Cup Day. [3] I am satisfied that the variation is consistent with the Wage Fixing Principles and the public interest requirements of the Act. The variation is made with the consent of the Tasmanian Trades and Labor Council. [4] The order reflecting this decision, with an operative date from 16 February 2009, is attached.
