REASONS FOR DECISION


[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 (the Act) by Health Services Union of Australia, Tasmania No. 1 Branch (the union) and Able Australia (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] A hearing commenced at the Edward Braddon Commonwealth Law Courts Building, 39-41 Davey Street, Hobart on 19 March 2009.

[3] The agreement, to be known as the Able Australia (Tasmania) Wages Agreement 2009, is to be operative from the first full pay period on or after 11 February 2009.

[4] The agreement has no application to employees who have or are employed to work with people with intellectual, physical, psychiatric, cognitive and/or sensory disabilities and who are employed in workshops or other premises established primarily to provide employment and training to such persons.

[5] Mr R Moore appeared for the union. Ms C Brown and Ms R McWaldron appeared for the employer.

[6] Having considered the consent submission of the parties, I am satisfied that the agreement is consistent with the Wage Fixing Principles and the public interest and no disadvantage tests required by the Act and I decide accordingly.

[7] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
