REASONS FOR DECISION


This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 (the Act) by the Community and Public Sector Union (State Public Services Federation Tasmania) Inc. (the union) and the Minister administering the State Service Act 2000 (the employer), was for the purpose of filing an industrial agreement with the Commission.

A hearing commenced at the Edward Braddon Commonwealth Law Courts Building, Hobart on Wednesday 4 March 2009.

The agreement, to be known as the Port Arthur Historic Site Staff Agreement 2009, is to be operative on and from 28 November 2008 and it is to remain in force until 30 June 2009.

The agreement applies to employees covered by the Port Arthur Authority Award.

Ms C Serra appeared for the union and Mr K Grey for the employer.  At the hearing, Clause 1.5 – Period of Operation – was amended.

Having considered the consent submission of the parties, I am satisfied that the agreement is consistent with the Wage Fixing Principles and the public interest and no disadvantage tests required by the Act and I decide accordingly.

The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
