TASMANIAN INDUSTRIAL COMMISSIONIndustrial Relations Act 1984
[1] On 5 March 2009, the Australian Education Union, Tasmanian Branch (the AEU) lodged with the Registrar, pursuant to Section 59 of the Industrial Relations Act 1984, an application to vary the Teaching Service (Tasmanian Public Sector) Salaries and Conditions of Employment Agreement 20081. [2] When this matter came on for hearing Mr C Lane appeared for the AEU; Mr P Baker, Mr M Watson, Mr P Gourlay, Ms J Fitton and Ms D Crespan appeared for the Minister. [3] The parties advised that the application sought to vary: Schedule 1- Incentive Payments for Employees in Designated School, Clause 2 - Incentives; and replace Schedule 3 – Salaries in the agreement, with an operative date of the first full pay period on or after 1 March 2009 and to remain in force until 28 February 2011. [4] Mr Watson, for the Minister, concurred with the submission of Mr Lane. [5] I am satisfied that the agreement is consistent with the Wage Fixing Principles and the public interest and no disadvantage tests required by the Act and I decide accordingly. [6] Pursuant to s.59(2) of the Act, the variation to the agreement is approved operative from the first full pay period on and from 1 March 2009. [7] An Order giving effect to the variation is attached.
