CORRECTIONAL OFFICERS INTERIM AGREEMENT 2008

REASONS FOR DECISION


[1] On 13 March 2009, the Minister administering the State Service Act 2000, The Community and Public Sector Union (State Public Services Federation Tasmania) Inc. and the Liquor, Hospitality and Miscellaneous Union - Tasmanian Branch lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Correctional Officers Interim Agreement 2008.

[2] When this matter came on for hearing on 18 March, 2009, Mr P Baker appeared for the Minister, Ms K Tyson appeared for the CPSU and Ms A Limbrick appeared for the LHMU.

[3] Ms Tyson explained that this agreement was to be read and applied in conjunction with the Custodial Officers Award and the Correctional Officers Agreement 2005.

[4] A number of clauses in the 2005 Agreement are rescinded, including Clause 10 Salary Nexus Arrangements. This has been replaced with Clause 12 Salaries, which provides for a 4% salary increase from 1 September 2008, and further 2% adjustments from 1 July 2009 and 1 December 2009.

[5] A number of new clauses have been included, including Clause 15 Absence Management and Clause 16 Work-Life Balance.

[6] Ms Limbrick supported the submissions of Ms Tyson and noted that the negotiations included matters going to uniforms and TRG training.

[7] Mr Baker observed that the negotiations had been conducted in a constructive atmosphere and that the salaries outcome had been balanced against the current difficult financial position of both the government and the wider economy.

[8] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act, and does not disadvantage the employees concerned.

[9] Pursuant to s55(4) of the Act, the Agreement is approved operative from 1 July 2008 and shall remain in force until 30 June 2010.

[10] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
