TASMANIAN INDUSTRIAL COMMISSION Industrial Relations Act 1984
and Family Planning Tasmania Inc.
[1] On 19 March 2009, the Health Services Union of Australia, Tasmania No. 1 Branch and Family Planning Tasmania Inc. lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Family Planning Tasmania Inc. Union Collective Agreement 2009. [2] When this matter came on for hearing on 30 March 2009, Ms T Rogers, with Ms S Goldfinch, appeared for the Health Services Union of Australia, Tasmania No. 1 Branch. Ms S Williams appeared for Family Planning Tasmania Inc. [3] Ms Rogers advised that the agreement replaces the Family Planning Tasmania Inc. Enterprise Agreement 2005 registered under Part 1VA of the Act. Further, Ms Rogers assured the Commission that the agreement did not disadvantage the employees subject to its terms. [4] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act, and does not disadvantage the employees concerned. [5] Pursuant to s55[4] of the Act, the agreement is approved operative from the beginning of the first pay period to commence on or after 1 January 2009 and shall remain in force for a period of three years. [6] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
