REASONS FOR DECISION

[1] On 24 March 2009, an application was lodged by the Minister administering the State Service Act 2000, pursuant to s.23 of the Industrial Relations Act 1984, to vary the Tasmanian State Service Award.  The application sought to add a new Appendix 10 –Information and Communication Technology Classification Structure.  At the hearing the parties sought to vary the application by adding a new Appendix 10 to the Health and Human Services (Tasmanian State Service) Award as well.

[2] The hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on 7 April 2009.  At the hearing Mr K Grey appeared for the Minister administering the State Service Act 2000.  Ms K Jackson appeared for the Community and Public Sector Union (State Public Services Federation Tasmania) Inc.  Mr D Pyrke appeared for the Association of Professional Engineers, Scientists and Managers, Australia.  All of the above gave oral submissions in support of the applications.

[3] I am satisfied that the variations are consistent with the Wage Fixing Principles and the public interest requirements of the Act. 

[4] The orders reflecting this decision, with the operative date of 7 April 2009, are attached.
