[2] When these matters came on for hearing on 1 April 2009, Mr M Watson and Mr T Kleyn appeared for the Minister administering the State Service Act 2000. Mr P Tullgren appeared for the Liquor, Hospitality and Miscellaneous Union - Tasmanian Branch. [3] Mr Watson explained that both agreements applied to all Department of Education and PY10 facilities. [4] The Salaries and Conditions of Employment agreement varies salaries to reflect the salary adjustments in the Tasmanian State Service Union Agreement 2008 . A number of allowances have been absorbed together with updating of the Protective Clothing and Split Shift Allowances. [5] The Job Security agreement replaces the Department of Education - School Attendants Industrial Agreement 2003 , and essentially continues the job security arrangement for a further five years. [6] Mr Kleyn supported the submissions of Mr Watson and referred to an ongoing review in relation to cafeterias. [7] Mr Tullgren advised that both agreements had been endorsed by members and assured the Commission that employees were not disadvantaged as a consequence. [8] I am satisfied that the agreements are consistent with both the Wage Fixing Principles and the public interest requirements of the Act, and do not disadvantage the employees concerned. [9] Pursuant to s55(4) of the Act, the agreements are approved. [10] The Salaries and Conditions of Employment agreement shall be operative from the beginning of the first pay period to commence on or after 1 December 2008 and shall remain in force until 30 June 2011. [11] The Job Security agreement shall be operative from the beginning of the first pay period to commence on or after 1 April 2009 and shall remain in force until 30 September 2013. [12] The files will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
