RECOMMENDATIONS


On 17 April 2009, an application was lodged by the Minister administering the State Service Act 2000 (MASSA), pursuant to s.23 of the Industrial Relations Act 1984, to vary the Nurses (Tasmanian Private Sector) Award 2005 re sick leave.

A hearing commenced at the Commonwealth Law Courts, Hobart, on Thursday 27 May 2009.  At the hearing Mr P Baker appeared for MASSA with Mr R Clegg of the Department of Health and Human Services.  Ms C Saint appeared for the Australian Nursing Federation Tasmanian Branch and Mr T Jacobson appeared for Health Services Union of Australia, Tasmania No. 1 Branch.

Following submission by the parties, I recommend that:

• the parties are to meet within two weeks of 27 May 2009;

• and that the representatives for MASSA are to bring to the meeting evidence of the extent of the problem. 

The matter was adjourned for a report back to the Commission on 18 June 2009 at 10.30 am at the Edward Braddon Commonwealth Law Courts Building.
