REASONS FOR DECISION


[1] On 15 May 2009, an application was lodged by The Australian Workers' Union, Tasmania Branch, pursuant to Section 23 of the Industrial Relations Act 1984, to vary the AWU (Tasmanian State Sector) Award.

[2] When this matter came on for hearing on 17 June 2009, Mr R Flanagan appeared for The Australian Workers' Union, Tasmania Branch and Mr K Grey appeared for the Minister administering the State Service Act 2000.

[3] Mr Flanagan explained that the purpose of this application (as amended) is to reflect changes arising as a consequence of the Tasmanian State Service Union Agreement 20081 applicable to the wider State sector. In particular this gives rise to a new classification and salary structure coupled with attendant translation arrangements.

[4] In addition, where conditions of employment differed between the State sector and the AWU award, the former will be substituted, provided there is no detriment to employees affected.

[5] Mr Grey endorsed the submissions of Mr Flanagan, and indicated that the new arrangements reflected a significant step forward in terms of award modernisation and, so far as it is practical, consistency across the State sector. Mr Grey also highlighted the new qualification standards which he was confident would be recognised Australia wide.

[6] I am satisfied that the application is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[7] The application is granted, operative from the beginning of the first pay period to commence on or after 5 March 2009.

[8] The Order reflecting this decision follows.
