REASONS FOR DECISION


[1] On 25 June 2009, an application was lodged by the Minister administering the State Service Act 2000 (MASSA), pursuant to Section 23 of the Industrial Relations Act 1984, to vary the Tasmanian Fire Fighting Industry Employees Award.

[2] This application is a consequence of an agreed settlement of a long running dispute which had previously been before the Commission1.

[3] The agreed settlement had been recorded in a memorandum of understanding (MOU). This MOU was subsequently modified as a consequence of the global financial crisis.

[4] This application introduces a new clause relating to superannuation. The effect of this clause is to preserve an additional 5% employer contribution over and above SGC requirements; for those members of the State Fire Commission Superannuation Scheme (SFCSS) who choose to exit the scheme prior to 14 November 2009.

[5] The clause also provides for a continuation of a 3% contribution into the RBF Accumulation Scheme for employees who were members of the SFCSS prior to 1 July 2005 and continue as members.

[6] I am satisfied that the application is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[7] The application is granted operative from 26 June 2009.
