REASONS FOR DECISION


[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 (the Act) by the Health Services Union of Australia, Tasmania No. 1 Branch (HSU1) (the union) and Able Australia Services (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] A hearing commenced at the Edward Braddon Commonwealth Law Courts Building, 39-41 Davey Street, Hobart on Thursday 9 July 2009.

[3] The agreement, to be known as the Able Australia (Tasmania) Wages Variation Agreement 2009, is to be operative from the first full pay period on or after 1 July 2009 and it is to remain in force for a period of 12 months.

[4] The agreement applies to all direct service employees employed by Able Australia Services irrespective of whether they are members of a registered organisation or not.

[5] Mr C Brown appeared for the union and Ms C Brown with Ms R McWaldron for the employer.

[6] Having considered the consent submission of the parties, I am satisfied that the agreement is consistent with the Wage Fixing Principles and the public interest and no disadvantage tests required by the Act and I decide accordingly.

[7] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
