DISABILITY SERVICES INDUSTRY WAGES AGREEMENT 2009

REASONS FOR DECISION


[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 (the Act) by the Health Services Union of Australia, Tasmania No. 1 Branch (the union) and National Disability Services Tasmania (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] A hearing commenced at the Edward Braddon Commonwealth Law Courts Building, 39-41 Davey Street, Hobart on Thursday 9 July 2009.

[3] The agreement, to be known as the Disability Services Industry Wages Agreement 2009, is to be operative from the first full pay period on or after 1 July 2009 and it is to remain in force for a period of 12 months.

[4] The agreement applies to employees who are engaged in the provision of support to persons with a disability for an employer named in Schedule A of the agreement.  It shall be read in conjunction with the Disability Service Providers Award and will apply to the extent of any inconsistency.  It provides for pay increases for the aforementioned employees.

[5] Mr C Brown appeared for the union and Mr J O’Neill for the employer.

[6] Having considered the consent submission of the parties, I am satisfied that the agreement is consistent with the Wage Fixing Principles and the public interest and no disadvantage tests required by the Act and I decide accordingly.

[7] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
