REASONS FOR DECISION

[1] This is an application pursuant to s.23 of the Industrial Relations Act 1984 (the Act), made by the Minister administering the State Service Act 2000 (the Minister) and lodged on 13 July 2009.

[2] Appearances: Mr P Baker for the Minister; Mr T Jacobson with Ms S Shay for the Health Services Union of Australia, Tasmania No. 1 Branch; and Ms K Jackson for The Community and Public Sector Union (State Public Services Federation Tasmania) Inc.

[3] The application sought to vary the Tasmanian State Service Award and the Health and Human Services (Tasmanian State Service) Award consistent with the variation to the rates as published by the Australian Taxation Office (Exhibit M.1).

[4] Having heard the submissions from the parties, I am satisfied that the Tasmanian State Service Award and the Health and Human Services (Tasmanian State Service) Award should be varied in the manner set out in the draft Order attached to the application.

[5] In correspondence dated 16 July 2009, the Transport Workers' Union of Australia (Victorian/Tasmanian Branch) advised that although it would not be represented at the hearing, it did, however, support the Minister’s application to vary certain expense related allowances.

[6] In approving the application, I am satisfied that the variation is consistent with the Wage Fixing Principles and the public interest requirements pursuant to s.36 of the Act.

[7] The Order giving effect to this decision will issue in due course and will be operative from the first full pay period to commence on or after 27 July 2009.
