REASONS FOR DECISION

[1] On 9 September 2009, the Australian Municipal, Administrative, Clerical and Services Union and Community Connections Incorporated lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the ASU-Community Connections Incorporated Agreement 2009.

[2] The matter was listed for hearing on 16 September 2009. Mr C Dodds, with Mr P Smith, appeared for the Australian Municipal, Administrative, Clerical and Services Union. Mr J West, for Community Connections Incorporated, appeared by way of audio-link.

[3] MR Dodds explained that the agreement replaces a previous agreement (T12209 of 2005) and is expressed in essentially the same terms. In addition, the agreement provides for Salary Packaging and Salary Sacrifice consistent with Commonwealth legislation.

[4] Mr Dodds assured the Commission that employees were not disadvantaged by the agreement.

[5] Mr West indicated employer consent to the agreement.

[6] I am satisfied that the agreement is consistent with the public interest requirements of the Act, and does not disadvantage the employees concerned.

[7] Pursuant to s55(4) of the Act, the agreement is approved operative from the beginning of the first pay period to commence on or after 1 October 2009 and shall remain in force for a period of three years.

[8] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
