REASONS FOR DECISION

[1] This is an application pursuant to s.23 of the Industrial Relations Act 1984 (the Act), made by the Minister administering the State Service Act 2000 (the Minister) and lodged on 14 September 2009.  Appearances: Mr F Ogle for the Minister; Mr R Warwick for the United Firefighters Union of Tasmania.

[2] The application sought to vary the Tasmanian Fire Fighting Industry Employees Award.  At the hearing Mr Ogle also sought to amend the application to include a new subclause (a)(ii).

[3] In Mr Ogle’s submission he requested the Commission amend the Tasmanian Fire Fighting Industry Employees Award in the following manner: Firstly, by deleting the date “14 November 2009”, wherever appearing, at Part III - Wages and Salary Provisions, Clause 3 - Superannuation and inserting in lieu thereof “14 December 2009”; secondly, to include a new subclause (a)(ii) as follows:

The additional employer superannuation contribution specified in sub clause (i) above will be treated for all purposes the same as if it were a superannuation guarantee contribution.”

[4] Mr Warwick consented to the application as amended.

[5] I am satisfied that the Tasmanian Fire Fighting Industry Employees Award should be varied in the manner set out in the amended draft Order.  In approving the application, I am satisfied that the variation is consistent with the public interest requirements of the Act.

[6] The Order giving effect to this decision is attached and will be operative on and from 24 September 2009.
