Rescission of award - award rescinded - operative 23 November 2009


REASONS FOR DECISION

[1] This application, made by the Minister administering the State Service Act 2000, sought to rescind the Sea Fisheries Award.

[2] The matter was set down for hearing on 23 November 2009 Hobart.

[3] The following organisations were advised of the hearing details:

• The Community and Public Sector Union (State Public Services Federation Tasmania) Inc.

• Tasmanian Trades and Labor Council

• The Minister Administering the State Service Act 2000

• Minister for Workplace Relations

[4] Ms J Fitton, for the Minister administering the State Service Act 2000, presented a submission to the Commission which, simply stated, confirmed that there are no longer any employees of Sea Fisheries; therefore the award no longer serves a purpose and should be rescinded.  Mr T Lynch appeared for the Community and Public Sector Union (State Public Services Federation Tasmania) Inc. and supported this view.

[5] Given the submissions of the parties to the award, I hereby determine that the Sea Fisheries Award be rescinded as an award of the Tasmanian Industrial Commission on and from the 23 November 2009, and I so Order.

[6] The Order giving effect to this decision is attached.
