Award variations - award varied - operative date from 23/11/09 REASONS FOR DECISION [1] On 5 October 2009, an application was lodged by the Minister administering the State Service Act 2000 (the applicant), pursuant to s.23 of the Industrial Relations Act 1984, to vary the Tasmanian State Service Award (the award). On 9 October 2009 the applicant lodged a further application (T13542 of 2009) to amend the award. The applications sought to amend the award and to tidy up any discrepancies and inconsistencies. [2] On 20 November 2009, Ms J Fitton informed the Commission that: Subject to the agreement of the other parties please also note it is our intention to request that T13540 of 2009 and T13542 of 2009 be joined together. [3] A hearing commenced in Hobart, on 16 October 2009. Ms Fitton appeared for the Minister administering the State Service Act 2000 with Ms A Dougan. Mr T Lynch appeared for the Community and Public Sector Union (State Public Services Federation Tasmania) Inc. with Ms H Nugent. Mr C Brown appeared for the Health Services Union of Australia, Tasmania No. 1 Branch with Ms R Salter. All of the parties gave oral submissions in support of the 59 variations to the award. [4] I am satisfied that the variations are consistent with the public interest requirements of the Act and the award will be varied in the manner sought. [5] The order reflecting this decision, with an operative date from 23 November 2009, is attached.
