REASONS FOR DECISION

[1] On 14 October 2009, the Health Services Union of Australia, Tasmania No. 1 Branch  and Nexus Inc. lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Nexus Inc. (Employment Conditions) Industrial Agreement 2009.

[2] When this matter came on for hearing on 20 October 2009, Mr R Moore, with Ms R Knox appeared for the Health Services Union of Australia, Tasmania No. 1 Branch. Ms C Durkin appeared for Nexus Inc.

[3] Mr Moore explained that this agreement replaces T13035 of 2007 - Nexus Inc. (Employment Conditions) Industrial Agreement 2007, and is to be read in conjunction with the relevant Award.

[4] The Agreement provides for a range of matters including Broken shifts; Shift work; Change of shift at short notice and Salary packaging.

[5] Ms Durkin indicated consent to the Agreement.

[6] I am satisfied that the agreement is consistent with the public interest requirements of the Act, and does not disadvantage the employees concerned.

[7] Pursuant to s55(4) of the Act, the agreement is approved operative from the beginning of the first pay period to commence on or after 1 October 2009 and shall remain in force until 30 June 2010.

[8] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
