REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 (the Act) by the Health Services Union of Australia, Tasmania No. 1 Branch (HSU1), the Community and Public Sector Union (State Public Services Federation Tasmania) Inc. (the unions) and the Public Sector Management Office on behalf of the Minister administering the State Service Act 2000 (the employer), was for the purpose of filing an industrial agreement with the Commission. 

[2] A hearing commenced in Hobart on Thursday 3 December 2009.

[3] The agreement, to be known as the Department of Health and Human Services Support Workers Agreement 2009, is to be operative on and from 3 December 2009, and it is to remain in force for a period of twelve months.

[4] The agreement applies to all staff employed under the provisions of the Health and Human Services (Tasmanian State Service) Award who are undertaking Support Worker duties in Disability, Child, Youth and Family Services.

[5] Mr R Moore of HSU1 appeared for the unions and Mr R Clegg for the employer.

[6] Having considered the consent submission of the parties, I am satisfied that the agreement is consistent with the public interest and no disadvantage test required by the Act and I decide accordingly.

[7] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
