Rescission of award – award rescinded - operative 9 December 2009

REASONS FOR DECISION

[1] This application, made by the Minister Administering the State Service Act 2000 (the Minister), sought to rescind the Printing Authority of Tasmania Award.  The matter was set down for hearing on Wednesday, 9 December 2009 at 9.30 am in the Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania.

[2] The following organisations were advised of the hearing details:

• The Public Officer, The Community and Public Sector Union (State Public Services Federation Tasmania) Inc;
• Automotive, Food, Metals, Engineering, Printing & Kindred Industries Union;
• Printing Authority of Tasmania;
• The Minister Administering the State Service Act 2000; and the
• Minister for Workplace Relations.

[3] Mr P Baker, for the Minister, and Mr T Lynch for The Community and Public Sector Union (State Public Services Federation Tasmania) Inc., presented submissions to the Commission which, simply stated, confirmed that the award no longer serves a purpose and should be rescinded.

[4] Given the submissions of the parties to the award, I hereby determine that the Printing Authority of Tasmania Award be rescinded as an award of the Tasmanian Industrial Commission on and from 9 December 2009, and I so Order.

[5] The Order giving effect to this decision is attached.
