REASONS FOR DECISION


[1] On 3 December 2009, an application was lodged by the Minister administering the State Service Act 2000, pursuant to s.23 of the Industrial Relations Act 1984, to vary the Port Arthur Authority Award re restructure of the award.

[2] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on 9 December 2009.  At the hearing Ms J Fitton appeared for the Minister administering the State Service Act 2000 with Ms C Armstrong for the Port Arthur Historic Site Management Authority.  Mr T Lynch appeared for the Community and Public Sector Union (State Public Services Federation Tasmania) Inc.

[3] Having heard the submissions from the parties, I am satisfied that the Port Arthur Authority Award should be varied in the manner set out in the draft Order produced by the Minister with the consent of the parties.

[4] In approving the application, I am satisfied it is not contrary to the public interest test required pursuant to s.36 of the Act.

[5] The Order giving effect to this decision is attached and will be operative on and from 26 November 2009.
