REASONS FOR DECISION


[1] On 9 December 2009, an application was lodged by the Minister administering the State Service Act 2000, pursuant to s.23 of the Industrial Relations Act 1984, to vary the Teaching Service (Tasmanian Public Sector) Award re school psychologists.

[2] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on 21 December 2009.  At the hearing Mr M Watson appeared for the Minister administering the State Service Act 2000 with Ms D Crespan.  Ms R Madsen appeared for the Australian Education Union, Tasmanian Branch.

[3] Having heard the submissions from the parties, I am satisfied that the Teaching Service (Tasmanian Public Sector) Award should be varied in the manner set out in the draft Order produced by the Minister with the consent of the parties.

[4] In approving the application, I am satisfied it is not contrary to the public interest test required pursuant to s.36 of the Act.

[5] The Order giving effect to this decision is attached and will be operative from the first full pay period to commence on or after 6 August 2009.
