REASONS FOR DECISION

[1] On 22 December 2009, GP Assist, the Australian Nursing Federation Tasmanian Branch (the ANF) and the Health Services Union of Australia, Tasmania No. 1 Branch (the HSUA) lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the GP Assist Tasmania Nurse Enterprise Agreement 2009/2010.

[2] The matter was listed for hearing at the Edward Braddon Commonwealth Law Courts Building, 39-41 Davey Street, Hobart, Tasmania on 23 December 2009 at 9.00 am.

[3] Ms C Davey appeared for the Australian Nursing Federation Tasmanian Branch with Ms E Smallbon.

[4] By way of email correspondence dated 22 December 2009, Ms E McShane for GP Assist and Mr C Brown for HSUA informed the Commission that they were unable to attend the hearing, and confirmed their consent to the agreement.

[5] Having considered the consent submissions of the parties, I am satisfied the agreement is consistent with the public interest and no disadvantage tests required by the Act, and I decide accordingly.

[6] Pursuant to s.55(4) of the Act, the agreement is approved, operative from the first full pay period to commence on or after 23 December 2009, and shall remain in force until 30 June 2010.

[7] The file will now be referred to the Registrar for registration in accordance with the requirements of s.56(1) of the Act.
