Rescission of award – award rescinded - operative 17 November 2010


REASONS FOR DECISION

[1] This application, made by the Minister administering the State Service Act 2000, (MASSA), sought to rescind the Tasmanian Museum and Art Gallery Award.

[2] The matter was set down for hearing on Wednesday, 17 November 2010 at 9.30 am in Hobart.

[3] The following organisations were advised of the hearing details:

• Community and Public Sector Union (State Public Services Federation Tasmania) Inc. (CPSU)

• Tasmanian Trades and Labor Council

• The Minister Administering the State Service Act 2000

• Minister for Workplace Relations

[4] Ms T Banman, for MASSA, and Ms S Harwood, for the CPSU, presented submissions to the Commission which, simply stated, confirmed that the award had been superseded by the new Tasmanian Museum and Art Gallery Hours Agreement 2010, therefore the award no longer serves a purpose and should be rescinded.

[5] Given the submissions of the parties to the award, I hereby determine that the Tasmanian Museum and Art Gallery Award be rescinded as an award of the Tasmanian Industrial Commission on and from the 17 November 2010, and I so Order.

[6] The Order giving effect to this decision is attached.
