TASMANIAN INDUSTRIAL COMMISSIONIndustrial Relations Act 1984 Minister administering the State Service Act 2000 and The Community and Public Sector Union (State Public Services Federation Tasmania) Inc.
[2] When this matter came on for hearing on 1 March 2010, Ms J Fitton appeared for the Minister with Ms J Crane, and Ms K Tyson appeared for the CPSU with Mr J McKenzie. [3] Ms Fitton advised that this agreement reflected the significant change in work patterns for compliance inspectors resulted in a reduced requirement for work outside ordinary hours. This included a reduction in the requirement to work public holidays. [4] The agreement provided for a transition payment equivalent to 10 days salary together with a review of planned work arrangements at three monthly intervals. [5] Ms Fitton said that clause 6 reflected the Departments intention to retire from the agreement at the conclusion of the period of operation. [6] In supporting the agreement Miss Tyson noted the employers intention to retire, indicating that the impact if any on employees effected would be an uppermost consideration. [7] I am satisfied that the agreement is consistent with the public interest requirements of the Act, and does not disadvantage the employees concerned. [8] Pursuant to s.55[4] of the Act, the agreement is approved operative from the first full pay period on or after 1 March 2010 and shall remain in force until from the first full pay period on or after 1 June 2011.
