REASONS FOR DECISION

[1] This is an application by the United Firefighters Union of Australia, Tasmania Branch, lodged pursuant to s.63 of the Industrial Relations Act 1984, seeking a determination of "Interest" in the above award.  The President has referred the application, pursuant to Section 63(10)(b), to myself for hearing and determination and, if necessary, subsequent award variation.  The application was set down for hearing in Hobart on 18 June 2010.

[2] Mr R Warwick appeared for the United Firefighters Union of Australia, Tasmania Branch.

[3] In support of the application Mr Warwick relied on membership lists and application forms.

[4] Having considered the submission, I am satisfied that:

• The Union has members engaged in the industry or occupation to which the Award relates;

• The membership is consistent with the organisations rules;

• The granting of the application would not prejudice the orderly conduct of industrial relations in Tasmania.

• The granting of the application is not against the public interest.

[5] I therefore find that the requirements of the Act have been satisfied.

[6] Pursuant to s.63(10)(c) the application is granted operative from 18 June 2010.

[7] A copy of this determination will be forwarded to the Registrar in accordance with s.63(12) of the Act.

[8] The Order giving effect to this decision is attached.
