REASONS FOR DECISION

[1] On 30 June 2010, an application was lodged by the Australian Education Union, Tasmanian Branch (AEU), pursuant to s.23 of the Industrial Relations Act 1984, to vary the Teaching Service (Tasmanian Public Sector) Award.

[2] A hearing commenced in Hobart on 13 July 2010.  At the hearing Mr C Lane appeared for the AEU, Tasmanian Branch.  Ms D Crespan of the Department of Education appeared for the Minister administering the State Service Act 2000 with Ms K Gunn. 

[3] Mr Lane submitted that this application sought to restore the purchasing power of Expense Related Allowances which had not been adjusted since March 2005.  Since that time the CPI had increased by 15.93%, which was the level of adjustment sought.

[4] Ms Crespan consented to the application.

[5] I am satisfied that the application is consistent with the public interest requirements of the Act.

[6] The application is granted operative from the beginning of the first pay period to commence on or after 13 July 2010.

[7] The order reflecting this decision follows.
