MIDWIFERY GROUP PRACTICE AT MERSEY COMMUNITY HOSPITAL AGREEMENT

REASONS FOR DECISION


[1] On 1 December 2010, the Minister administering the State Service Act 2000 (MASSA), the Australian Nursing Federation Tasmanian Branch (ANF) and the Health Services Union of Australia, Tasmania No. 1 Branch (HSU1) lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Midwifery Group Practice at Mersey Community Hospital Agreement.

[2] When this matter came on for hearing on 9 December 2010 in Hobart, Mr P Baker appeared for the MASSA, Ms N Ellis appeared for the ANF and Mr T Jacobson appeared for the HSU1.

[3] This agreement embraces the concept of an annualized salary coupled with flexible working hours such as to facilitate the new model of care recognized by the parties as representing ‘best practice’.

[4] Notwithstanding the ‘No Extra Claims’ clause the parties agree that the arrangements will require an ongoing review which may in fact necessitate certain aspects, including the salary loading, being revisited during the currency of the agreement.

[5] I am satisfied that the agreement is consistent with the public interest requirements of the Act, and does not disadvantage the employees concerned.

[6] Pursuant to s55(4) of the Act the agreement is approved operative from the beginning of the first pay period to commence on or after 9 December 2010 and shall remain in force until 30 September 2011.
