REASONS FOR DECISION

[1] On 15 December 2010, an application was lodged by the Minister administering the State Service Act 2000, (MASSA) pursuant to s.23 of the Industrial Relations Act 1984, to vary the Post Year 10 Teaching Staff Award.  The award was consolidated and re-named the Polytechnic and Skills Institute Teaching Staff Award.

[2] A hearing commenced in Hobart on 21 December.  At the hearing Mr T Kleyn appeared for MASSA.  Mr C Lane appeared for the Australian Education Union, Tasmanian Branch.   Both of the above gave oral submissions in support of the application.

[3] I am satisfied that the variation is consistent with the public interest requirements of the Act.  

[4] The order reflecting this decision, with an operative date from the first full pay period to commence on or after 1 January 2011, is attached.
