Industrial Agreement variations - approved – operative 1/1/2011 – to remain in force until 20/10/2011

REASONS FOR DECISION

[1] This application, lodged pursuant to s.59 of the Industrial Relations Act 1984 by the Australian Education Union, Tasmanian Branch, (AEU), and the Minister Administering the State Service Act 2000, (MASSA), was for the purpose of filing variations to the Post Year 10 Teaching Staff Industrial Agreement 2009 with the Commission.

[2] A hearing commenced in Hobart on 21 December 2010.

[3] The agreement, re-named as the Polytechnic and Skills Institute Teaching Staff Industrial Agreement 2011, is to be operative on and from 1 January 2011 and remain in force until 20 October 2011.

[4] The agreement shall apply in respect of the employment of all persons employed under that State Service Act 2000 in classifications contained in the Polytechnic and Skills Institute Teaching Staff Award and employed in the Department of Education - Tasmanian Polytechnic or the Skills Institute.

[5] Mr C Lane, for the AEU, and Mr T Kleyn, for MASSA, presented submissions in support of their consent application.

[6] Having considered the consent submissions of the parties, I am satisfied the agreement is consistent with the public interest and no disadvantage tests required by the Act, and I decide accordingly.

[7] An Order giving effect to the variation is attached.
