LEGAL PRACTITIONERS AGREEMENT 2010

REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Community and Public Sector Union (State Public Services Federation Tasmania) Inc. (CPSU), and the Minister Administering the State Service Act 2000 (MASSA), was for the purpose of filing an industrial agreement with the Commission.

[2] A hearing commenced in Hobart on 22 December 2010.  At the hearing Ms J Fitton appeared for MASSA and Mr M Johnston appeared for the CPSU.

[3] The agreement, to be known as the Legal Practitioners Agreement 2010, is to be operative on and from 22 December 2010 and remain in force until 31 July 2013.

[4] The agreement shall apply in respect of all Tasmanian State Service employees appointed to legal practitioner duties and all State Service Officers appointed under s29 of the State Service Act 2000.

[5] Ms Fitton and Mr Johnston presented submissions in support of their consent application.

[6] Having considered the consent submissions of the parties, I am satisfied the agreement is consistent with the public interest and no disadvantage tests required by the Act, and I decide accordingly.

[7] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
