REASONS FOR DECISION

[1] On 20 December 2010, an application was lodged by the Minister administering the State Service Act 2000, (MASSA), pursuant to s.23 of the Industrial Relations Act 1984, to vary Legal Practitioners and Apprentice-at-Law Award.  The award was consolidated and re-named the Legal Practitioners Award.

[2] A hearing commenced in Hobart on 22 December 2010.  At the hearing Ms J Fitton appeared for MASSA.  Mr M Johnston appeared for the Community and Public Sector Union (State Public Services Federation Tasmania) Inc.   Both of the above gave oral submissions in support of the application.

[3] The following clauses were varied:

• Part I - Clause 1 - Title
• Part I - Clause 4 - Date of Operation
• Part I - Clause 8 - Salaries
• Clause 9 - Classification Standards
• Clause 10 - Advancement between Classifications and Increments
• Clause 15 - General Terms and Conditions of Employment

[4] I am satisfied that the variations are consistent with the public interest requirements of the Act.  

[5] The order reflecting this decision, with an operative date from 22 December 2010, is attached.
