Industrial Agreement - approved - operative on and from ffpp 1 December 2010 - to remain in force until 31 March 2011 or until a replacement agreement is registered with the Commission - forwarded to the Registrar for registration

REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Australian Nursing Federation Tasmanian Branch, (ANF), and the Minister Administering the State Service Act 2000, (MASSA), was for the purpose of filing an industrial agreement with the Commission.

[2] A hearing commenced in Hobart on 23 December 2010.

[3] The agreement, to be known as the Nurses and Midwives Heads of Agreement 2010, is to be operative on and from the first full pay period 1 December 2010 and remain in force until 31 March 2011 or until a replacement agreement is registered with the Commission.

[4] The agreement shall apply in respect of the employees covered by the Nurses (Tasmanian Public Sector) Award 2005.

[5] Mr P Baker, for the MASSA, and Ms N Ellis, for the ANF, presented submissions in support of their consent application.

[6] Having considered the consent submissions of the parties, I am satisfied the agreement is consistent with the public interest and no disadvantage tests required by the Act, and I decide accordingly.

[7] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
