REASONS FOR DECISION

[1] On 29 July 2011, an application was lodged by the Minister administering the State Service Act 2000 (MASSA) and the Community and Public Sector Union (SPSFT) Inc, (CPSU), pursuant to s.59 of the Industrial Relations Act 1984, to vary the Legal Practitioners Agreement 2010. 

[2] A hearing was conducted in Hobart on 4 August 2011.  At the hearing Mr K Grey appeared for MASSA.  Mr M Johnston appeared for CPSU.   Both parties consented to the application.

[3] By way of explanation Mr Johnston submitted that the variation is a remedy for a previously undetected calculation error.

[4] The Level 4 Rates of Pay were deleted and replaced in Schedule 1 Legal Practitioners Classifications and Rates of Pay

[5] I am satisfied that the variation is consistent with the public interest requirements of the Act.  

[6] The order reflecting this decision, with an operative date from the first full pay period on or after 4 August 2011, is attached.
