Award variation – wage rates – operative date ffpp on or after 1/8/11 – consent orders issued

REASONS FOR DECISION

[1] On 5 August 2011, an application was lodged by the Minister administering the State Service Act 2000, (MASSA) pursuant to s.23 of the Industrial Relations Act 1984, to vary The Tasmanian State Service National Training Wage Award.  The application sought to vary Clause 12 – Wages.

[2] All parties to the application were notified of the time and date of the hearing by Notice of Hearing dated 17 August 2011.

[3] At the hearing in Hobart on 24 August 2011, Mr K Grey appeared for the MASSA.  Mr M Johnston appeared for the Community and Public Sector Union (SPSFT) Inc. (CPSU) and Mr J Eddington appeared for the Health Services Union of Australia, Tasmania No. 1 Branch (HSUA1).

[4] Mr Grey submitted that the application sought to vary wage rates in accordance with Fair Work Australia Determination PR509041.

[5] The CPSU and the HSUA1 consented to the application on 26 August 2011.

[6] I am satisfied that the variation is consistent with the public interest requirements of the Act.

[7] The application is granted and the Award is varied operative from the beginning of the first pay period to commence on or after 1 August 2011.

[8] The orders reflecting this decision will follow.
